LDDP Successfully Represented the Special Administrator in Bankruptcy Proceedings
LDDP successfully represented the special administrator in bankruptcy proceedings, securing the final dismissal of the judicial liquidator’s action for the annulment of the company’s resolutions concerning the distribution and payment of dividends amounting to LEI 14,768,281 during the observation period.
Both the syndic judge and the court of appeal found the arguments brought by the LDDP team convincing and ruled that the insolvency rules do not apply in the case of dividend restitution, any such issues being governed by company law.
