
We are pleased to have assisted S. Parc Fotovoltaic Turceni S.A., the project company jointly owned by Tinmar Energy and Complexul Energetic Oltenia, in the successful defence of the award decision in the EPC procurement procedure against all challenges brought by unsuccessful bidders.
The Turceni project forms part of a portfolio of four photovoltaic projects, representing a combined installed capacity of 395 MWp and a total investment of approximately EUR 243 million, financed through the Modernisation Fund and forming a key component of Romania’s energy transition and the decarbonisation programme of Complexul Energetic Oltenia.
Beyond their scale, these projects are of strategic national and European importance. They form part of the restructuring and decarbonisation programme of Complexul Energetic Oltenia, approved by the European Commission, and support Romania’s transition from coal-fired generation to renewable energy. Their implementation contributes to Romania’s commitments towards the European Union regarding decarbonisation, energy transition, security of supply and the gradual phase-out of coal-fired generation.
The mandate required the coordination of complex legal issues spanning public procurement, energy regulation, EU funding and strategic litigation, in the context of one of Romania’s largest renewable energy investments and a flagship project within Romania’s decarbonisation programme. The challenges raised issues extending well beyond conventional procurement disputes, requiring a strategic understanding of the interaction between public procurement law, energy regulation, EU funding requirements and the legal framework governing Romania’s decarbonisation commitments.
LDDP provided strategic legal advice, public procurement legal advice and representation throughout the challenge proceedings, supporting the project company in defending the legality and integrity of the procurement process and the award decision against all claims raised by the unsuccessful bidders.
The successful rejection of all challenges provides legal certainty for the continuation of a strategic investment that will contribute significantly to Romania’s renewable energy capacity while supporting the implementation of one of the country’s most important decarbonisation programmes.
The LDDP team worked in close coordination with SC INTEGRATE INVESTMENT SRL, acting as the provider of auxiliary purchasing activities for the Project Company, bringing together complementary legal and procurement expertise throughout this critical stage of the process.
